Chairman John McClelland called the meeting to order at 7:38 p.m. In attendance were Commissioners Vicki Andrews, Darrell Anderson, Bob Evans, John McClelland and alternate Jim Leng.

Approval of Minutes

The minutes for July were approved.

Town Council Report

Darrell Anderson reported that at a working session on the Master Plan Review the Town Council requested further review of Section 7 regarding the Commercial Corner by the task force. The Council is planning to complete the Review in December 2002 or January 2003.

Building Permits

John McClelland reported that the Neumanns at 500 McCauley Street have submitted a permit application (for a fence) with attached boundary survey that brought to light disparities in property lines. The Planning Commission reiterated the policy that was established prior to the start of the survey that property lines should not be moved based on survey results (see Planning Commission Minutes, October 2001.) John McClelland also reported that Town attorney Bill Roberts recommended that the Planning Commission not get involved in private property disputes.

Ordinance Revision

A discussion of Ordinance revisions was held based on some preliminary changes made by John McClelland. Following are the Articles and Sections that were discussed and amended: Article I, Section 12; Article III, Sections 7 and 11; Article IV, Section 2; Article V, Section 2; addition of Article V, Section 5; Article VII, Sections 3, 4.2, 5, 7, 8, and 9 (attached.)

A recommendation was made to lower the Town speed limit to fifteen. Bob Evans reported a discussion with a former Town mayor regarding the potential loss of State Highway Administration funding if the speed limit was changed. The Commission agreed to recommend the change subject to establishment that it would be a valid exercise of the town’s authority and would not jeopardize state highway funds.

John McClelland introduced the topic of whether boundary surveys should be required for building permit submissions for fences located on or within one foot of a property line. Vicki Andrews said she would be in favor of them in disputed cases. John reported that the surveys can be costly and might be prohibitive in some cases. Bob Evans said he agreed with John and thought they should be eliminated from the ordinance.

At the conclusion of the discussion, all present members of the Planning Commission approved the ordinance revisions.
