ORDINANCE
TO AMEND THE CODE OF ORDINANCES, ARTICLE II, “PUBLIC HEALTH”, BY ENACTING A NEW SECTION 7, “SMOKING IN PUBLIC BUILDINGS AND VENUES”, TO PROHIBIT SMOKING WITHIN FIFTY (50) FEET OF DESIGNATED PUBLIC SPACES AND TO MAKE A NUMBERING CHANGE

WHEREAS, §5-201 et seq. of the Local Government Article, Annotated Code of Maryland, authorizes the Mayor and Council to adopt such ordinances as it deems necessary to assure the good government of the Town of Washington Grove; to protect and preserve the rights, property and privileges of the Town; to preserve peace and good order; to secure persons and property from danger and destruction; and to protect the health, comfort and convenience of Town residents; and

WHEREAS, the purpose of Article II, “Public Health” is to promote public health by requiring that real property be kept clean, free of infestations, and in repair, and to authorize the Mayor and Council to compel compliance or to correct non-compliance; and

WHEREAS, the Mayor and Council of the Town of Washington Grove have determined that it is in the public interest to address smoking in public buildings and venues; and

WHEREAS, the Mayor and Council of the Town of Washington Grove wish to conform the Town Code to be in accord with Montgomery County smoking restrictions.

NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council of the Town of Washington Grove, that Article II, Sections 7 and 8 are hereby repealed, re-enacted, re-numbered and amended to read as follows:

Section 7. Smoking in Public Buildings and Venues

Smoking of any kind within fifty (50) feet of the entrances of McCathran Hall and Town offices is prohibited. Smoking of any kind within fifty (50) feet of public playground equipment, and the shores of Maple Lake is prohibited.

Section 8. Conflict with Other Laws

The foregoing Sections 1 through 7, contain minimum requirements for the protection of health and are in addition and supplementary to any other ordinances, laws, rules and regulations and nothing therein shall be construed to affect in any manner any of the powers and duties of the State Board of Health, County Board of Health or any Public General or Public Local Law relating to the subject of health.

EFFECTIVE DATE: This ordinance shall become effective thirty (30) days from the date of adoption unless petitioned to referendum in a manner prescribed by law.
