Councilman Evans called the meeting to order at 7:30 p.m. In attendance were Commissioners Charlie Challstrom, Peggy Ebner, Bud O’Connor and alternate Joe Clark. Also in attendance were town residents Tom Appleby, Georgette Cole, Tony Hunter and Maggie Range. Chairman John McClelland came at 8:20 p.m. and chaired the meeting from that point on.
Approval of Minutes
The minutes for May were approved.
Building Permits
The following building permits were reviewed by the Planning Commission (PC):
- 112 Chestnut Avenue – Demolition permit approved unanimously per Article 4, Section 1.
- 348 Ridge Road – Fence approved unanimously per Article 7, Section 3.328.
- 8 Circle – Two foot fence denied because of its location on Town property. The resident was also informed that the fence would be approved if it was installed on her property. A survey will also be required showing the fence location on private property.
The commissioners also discussed a fence (according to the current ordinance definition) that has been installed at 1 Circle without a permit. Chairman McClelland has spoken with the owner and requested that he apply for a permit.
Master Plan Revision
Darrell Anderson is working on compiling the individual Sections prepared by the commissioners into a cohesive document.
Report from Town Council
The Council held a Public Hearing on the Cator Property Annexation. The Planning Commission defined three conditions associated with the subdivision plat (see below) that will place covenants on the four lots. Building permits will be issued if all annexation and subdivision conditions are met. A motion was approved unanimously to send the following covenants to the Council:
- Open front porches
- Detached garages
- 0.3 acres of aforestation on site in one continuous strip
Commercial Corner
The commissioners discussed Pop’s Tattoo Parlor’s request for a business license at the Commercial Corner. Chairman McClelland reported that Montgomery County does not allow tattoo parlors at all and that Gaithersburg only allows them in specific industrial zones and not within 1,000 feet of schools, residences or churches. The commissioners agreed that since tattoo parlors are not an approved use for the Commercial Corner in the ordinances and because of the rulings in neighboring jurisdictions, a tattoo parlor cannot be treated as a beauty salon and the request for license was denied.
