COUNCIL OF THE TOWN OF WASHINGTON GROVE, MARYLAND
ORDINANCE TO AMEND ARTICLE II SECTIONS 7 AND 8 OF THE CODE OF ORDINANCES REGARDING PUBLIC HEALTH
WHEREAS, the purpose of Article II; Public Health is to promote public health by requiring that real property be kept clean, free of infestations, and in repair, and to authorize the Mayor and Council to compel compliance or to correct non-compliance; and
WHEREAS, the Mayor and Council of the Town of Washington Grove are obliged to address smoking in public buildings and venues; and
WHEREAS, the Mayor and Council of the Town of Washington Grove wish to be in accord with Montgomery County smoking restrictions;
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Town Council of the Town of Washington Grove, that Article II Sections 7 and 8 are hereby modified to read:
Section 7. Smoking in Public Buildings and Venues
There will be NO smoking within 50 feet of the entrances of McCathran Hall and Town offices. No Smoking within 50 feet of public playground equipment, and the shore of Maple Lake.
Section 8. Conflict with Other Laws
The aforegoing Sections 1 through 8, contain minimum requirements for the protection of health and are in addition and supplementary to any other ordinances, laws, rules and regulations and nothing therein shall be construed to affect in any manner any of the powers and duties of the State Board of Health, County Board of Health or any Public General or Public Local Law relating to the subject of health.
EFFECTIVE DATE: This ordinance shall become effective thirty (30) days from the date of adoption hereof in the absence of a petition by qualified voters as set forth in Section 15 of the Charter of the Town, and in the event of such a valid petition, this ordinance shall become effective in accordance with the aforesaid Section 15 upon the happening of those events set forth therein.
